These terms govern your use of the unTether website at tryuntether.com and the unTether softphone applications, provided by Untether Communication, LLC ("unTether", "we", "us"). By using the website or the application, you agree to them.
1. The service
unTether provides softphone application software for desktop and mobile devices. The application is a client that connects to a third-party VoIP or SIP telephony service that you obtain separately. unTether is not a telephone company, is not a telecommunications carrier, and does not itself provide telephone service, phone numbers, or call carriage.
2. Emergency calling
Important. unTether does not provide emergency calling. The application is not a replacement for your traditional or mobile telephone service. Whether a call to 911 or another emergency number succeeds depends entirely on your VoIP provider, your internet connection, your device, and your power supply, none of which we control. Do not rely on unTether to reach emergency services. Always keep an alternative means of placing an emergency call available.
3. Your account and your provider
You are responsible for obtaining and maintaining your own VoIP or SIP service, for the accuracy of the connection details you enter, and for keeping your credentials confidential. You are responsible for all activity that occurs through your credentials. Your relationship with your VoIP provider, including all charges for calls, is between you and that provider.
4. Acceptable use
You agree not to use the service to:
- Violate any applicable law or regulation, including telemarketing, robocalling, caller ID spoofing, and call recording consent laws.
- Place harassing, fraudulent, threatening, or abusive calls.
- Infringe the rights of others or transmit unlawful content.
- Interfere with, disrupt, overload, or attempt to gain unauthorized access to the service or any related systems.
- Reverse engineer, decompile, or disassemble the software, except to the extent that restriction is prohibited by applicable law.
Recording a call may require the consent of some or all parties depending on jurisdiction. You are solely responsible for complying with those laws.
5. License
Subject to these terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the unTether application on devices you own or control. We reserve all rights not expressly granted. The software is licensed, not sold.
6. Intellectual property
The service, the software, and all associated content, trademarks, and logos are owned by Untether Communication, LLC or its licensors and are protected by intellectual property law. "unTether" and the unTether logo are our trademarks. Nothing in these terms transfers ownership of anything to you.
7. Development status and availability
unTether is under active development. Features described on this website are subject to change, may be delayed, or may not ship. We may modify, suspend, or discontinue any part of the service at any time. We do not guarantee that the service will be uninterrupted, timely, secure, or error-free.
8. Third-party services
The application interoperates with services we do not control, including your VoIP provider, your operating system vendor's push notification service, and your network provider. We are not responsible for those services, their availability, or their terms.
9. Disclaimer of warranties
The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law.
10. Limitation of liability
To the fullest extent permitted by law, Untether Communication, LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, arising out of or relating to your use of or inability to use the service, including any failure to complete a call, whether based in contract, tort, or any other theory, even if advised of the possibility of such damages. Our total aggregate liability for all claims relating to the service will not exceed the greater of the amount you paid us for the service in the twelve months preceding the claim or one hundred United States dollars.
Some jurisdictions do not allow certain exclusions or limitations, so parts of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Untether Communication, LLC from any claims, damages, liabilities, and expenses, including reasonable attorneys' fees, arising out of your use of the service, your violation of these terms, or your violation of any law or the rights of a third party.
12. Termination
We may suspend or terminate your access to the service at any time if you breach these terms or if we discontinue the service. You may stop using the service at any time by uninstalling the application. Sections that by their nature should survive termination will survive.
13. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. The exclusive venue for any dispute will be the state or federal courts located in Texas, and you consent to their personal jurisdiction.
14. Changes to these terms
We may update these terms as the product develops. When we do, we will revise the "Last updated" date above. Continued use of the service after changes take effect constitutes acceptance of the revised terms.
